The Timeline for Compliance

The Security Industry Authority (SIA) has been designated as the regulator. They will have the authority to inspect premises, issue improvement notices, and levy significant fines for non-compliance.
Does Martyn’s Law Apply to Your Business?
The Act applies to “qualifying premises” that are used for purposes such as retail, hospitality, entertainment, education, healthcare, and leisure. The requirements are divided into two tiers based on the capacity of the premises:
1. The Standard Tier (200 – 799 People)
This tier applies to premises with a capacity of 200 to 799 individuals. For most businesses in this category, the focus is on preparedness and procedural clarity rather than extensive physical security upgrades.
Key Requirements:
- Notification: Registering the premises with the SIA.
- Preparedness: Implementing “reasonably practicable” public protection procedures.
- Staff Awareness: Ensuring staff know what to do in the event of an attack.
2. The Enhanced Tier (800+ People)
Premises with a capacity of 800 or more, as well as certain qualifying public events, fall into the Enhanced Tier. Because of the higher volume of people, the requirements are more stringent.
Additional Requirements:
- Vulnerability Assessments: A formal assessment of how the premises might be vulnerable to an attack.
- Documented Measures: Detailed plans on how vulnerability and risk of physical harm will be reduced.
- Designated Lead: Appointing a senior individual responsible for compliance.
- Monitoring: Implementing measures to monitor the premises and its immediate vicinity.
The Four Required Public Protection Procedures
Whether your business falls into the Standard or Enhanced tier, you must have four core procedures in place. These procedures are designed to protect the public and staff during an incident:
- Evacuation: Clear, practiced routes to get people away from danger and out of the premises quickly.
- Invacuation: Moving people to a safe, protected internal space if it is safer than leaving the building.
- Lockdown: Securing the premises to prevent an attacker from entering or moving through the building. This often involves advanced access control systems.
- Communication: Reliable systems to alert everyone on-site to the danger and provide instructions.
